Unions

If employees request the establishment of a union, the employer must assent and offer assistance. Moreover, they apply certain thresholds that require employers to hire an employee full-time representative of work (companies with at least 200 employees must hire a labor representative of employees, necessary contracts with more higher thresholds). Joint Ventures and such companies should allocate an amount at least equal to two percent of the monthly salary paid of all employees and union funds (this amount is payable to the local employment office if the company has not established a trade union). The union must use these funds trade under the management of Union funds measures issued by the China Federation of Trade Unions, of which the union is bound to be a member.

Union representatives are entitled to attend board meetings but not
have voting rights and should be invited to attend board meetings, if discusses labor issues. The union made a significant advisory role with respect to individual employment contracts and collective termination of employees, mediation of conflicts, redundancies, and to help redundant employees find new employment. The union can not impose its will upon the employer in these matters. Interestingly, unions are not even the right to strike. However, the union consent is required in some mergers and acquisitions.

Communist Party of the Organization

If employees request the establishment of a Communist Party organization in the workplace, the employer must consent and may be compelled to give assistance. A Communist Party organization should be established in any workplace with at least three members of the Communist Party, and the employer is obliged to accommodate and support it (the details of this obligation remains ambiguous on this point but will likely vary depending on company size and level of party member Communist employees).
